Garnishment order under Korean law

With the judgment rendered by the court, creditor can apply for garnishment.



Judgment creditor can ask the court for an order of garnishment in order to attach an outstanding credit of judgment debtor. Such an order prohibits the garnishee from discharging debts to the original debtor, and also forbids the judgment debtor from disposing of or accepting payment for credit. Payment made in violation of the garnishment order will not have legal effects against the garnishor. For the reasons mentioned above, it is strongly advised to apply for a garnishment order after judgment as a basic step in collecting money.
